Man Found Not Guilty of Drunk Driving
Southern Berkshire Register – September 3, 2021
Great Barrington >> A Berkshire County Judge found a 55-year-old resident not guilty of operating under the influence of alcohol after trial.
David Wasuk was slapped with the charges after he was stopped by Lee Police on April 12, 2021. According to police reports, Lee Police pulled over Wasuk in a red pickup truck that belonged to his girlfriend around 10:00 pm. His girlfriend reported to police that Wasuk stole her vehicle after a verbal dispute at their home.
Police officers testified that during their motor vehicle stop, they noticed Wasuk had bloodshot eyes, was unsteady on his feet, and had an odor of alcohol. Wasuk allegedly admitted to the officers that he had 3 beers that night but insisted he was not under the influence. Due to previous back injuries, Wasuk refused to do the standard field sobriety tests. Later at the station, Wasuk also refused to give a breath sample to determine sobriety.
Wasuk’s lawyer, Marc Vincelette of Pittsfield, argued that there was not enough evidence to prove his guilt beyond a reasonable doubt. Wasuk and his lawyer waived the right to a jury trial and instead elected to have it decided by Judge Paul Vrabel. Wasuk was not charged with the theft of the vehicle.
